Debated But Not Resolved
Live entertainment hours (3:00 a.m. vs. 5:00 a.m.) — Commissioner Velto argued other nearby bars already operate until 5:00 a.m., making a 3:00 a.m. cutoff unfair to new applicants. Commissioners Villanueva and Del Villar countered that 3:00 a.m. should be standard for consistency with Code Enforcement and respect for 2,000 nearby residents. Staff noted pre-2003 businesses are grandfathered under older rules. Underlying tension between case-by-case business evaluation and standardized regulations remains unresolved.
DJ recorded music loophole — Chair Rohrmeier called the rule "overreach": a DJ must stop at 3:00 a.m., but recorded music via speakers can play 24 hours. Commissioner Velto questioned the practical difference. Staff acknowledged this is a gray area in city code that may need future clarification.
Consistency across entertainment district — Commissioners disagreed whether other bars truly operate until 5:00 a.m. without permits. Staff explained new CUP applicants face stricter conditions than legacy businesses, but no action taken to address the inconsistency.
